Terms of Service

Welcome to Mount Masters! These Terms of Service govern your use of our website located at

mountmasters.ca (the "Site") and the services provided therein (collectively, the "Services"), operated by Mount Masters.

By accessing or using our Services, you agree to comply with and be bound by these Terms of Service. If you disagree with any part of these terms, please refrain from accessing or using our Services.

1. Use of Services

1.1 Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

1.2 License: Subject to these Terms of Service, Mount Masters grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal or internal business purposes.

1.3 Prohibited Activities: You agree not to engage in any of the following prohibited activities:

- Violating any laws, regulations, or third-party rights;

- Using the Services for any unlawful, fraudulent, or unauthorized purpose;

- Interfering with the operation of the Services or the networks connected to the Services;

- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;

- Collecting or harvesting any information from the Services;

- Uploading, transmitting, or distributing any content that is unlawful, harmful, or infringes any third-party rights.

2.1 Account Creation: In order to access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Mount Masters immediately of any unauthorized use of your account or any other breach of security.

3. Intellectual Property

3.1 Ownership: Mount Masters owns all rights, title, and interest in and to the Services, including all intellectual property rights therein.

3.2 Restrictions: You agree not to reproduce, modify, distribute, display, perform, or otherwise use the Services, in whole or in part, without Mount Masters' prior written consent.

4. Disclaimer of Warranties

4.1 The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.

4.2 The only guarantee offered by mount masters is that the mounts we provide will be free of defects for up to 1 year.

4.3 We cannot guarantee the construction of your wall or the ability of your wall to withstand the weight of any TV, painting, mirror or any other item which we are contracted to hang onto the wall on your behalf.

5. Limitation of Liability

5.1 To the fullest extent permitted by applicable law, Mount Masters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services.

6. Governing Law

6.1 These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

7. Changes to Terms of Service

7.1 Mount Masters reserves the right to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.

9. Damages

9.1 Mount Masters strives to provide exceptional TV mounting services, however, we cannot guarantee the condition of your property before, during, or after the service.

9.2 While our technicians exercise caution and professionalism, Mount Masters shall not be liable for any damages to your property, including but not limited to walls, ceilings, furniture, or electronic devices, arising from the provision of our services.

9.3 Mount Masters shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services, including but not limited to loss of profits, loss of data, or damage to personal belongings.

9.4 By engaging Mount Masters for TV mounting services, you acknowledge and accept the inherent risks associated with the installation process. You agree to hold Mount Masters harmless from any claims, damages, or liabilities arising from the provision of our services.

9.5 In the event that damages occur during the provision of our services, Mount Masters' liability shall be limited to the cost of repairing or replacing the damaged property, at our discretion.

9.6 Mount Masters reserves the right to assess the extent of damages and determine appropriate remedial action. Any disputes regarding damages shall be resolved in accordance with the terms outlined in our service agreement.

9.7 By engaging Mount Masters for TV mounting services, you agree to release, indemnify, and hold harmless Mount Masters, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising from the provision of our services.

10. Labour, Material and Other Charges

10.1 Mount Masters reserves the right to charge up to $125 per hour for additional labour which was not agreed upon during quotation. This does not include the cost of additional materials which may be needed in order to complete additional labour

10.2 Credit card payments are subject to a 3% payment processing fee in addition to HST (13%)

10.3 If the technician arrives for a scheduled appointment and the customer is not prepared to complete the installation with the customer provided materials then Mount Masters reserves the right to charge a $100 "missed appointment fee" - This is to cover the lost time for non-completion of a scheduled installation.

10.4 Mount Masters accepts all major credit cards, cash and e-transfer as forms of payment. Personal cheques are not accepted as a form of payment. Official receipt for payment is completed via email and/or text message, complete with our HST number.

Concealment Agreement

This Agreement, known as the Customer Work Agreement, is established between Auxe Inc. (referred to as the "Company") and the undersigned individual (referred to as the "Customer").

The agreement outlines the customer's request and consent for specific tasks, including drywall incisions, installation of approved wires, and the placement of concealment and gang plates, all aimed at internal cord-concealment purposes.

Auxe understands that the customer claims sole ownership of the building where Auxe operates. The customer acknowledges full liability for the concealment process, with Auxe absolved of responsibility for any resulting damages. Auxe operates under the belief that the customer provided direction regarding the locations for internal concealment.

This contract confirms Auxe's compliance with the "2018 Canadian Electrical Code" and relevant Provincial regulations. Notably, Auxe and its representatives do not install high-voltage cables behind drywall; this remains the homeowner's responsibility.

In witness thereof, the parties have executed this Agreement through their duly authorized representatives, effective as of the date first mentioned above.
